Personal Training Terms & Conditions

1. General provisions
These Terms & Conditions set out the rules for personal training sessions ("Sessions") provided by Jakub Pokora, NIP: 8982318310, REGON: 541153207 (the "Trainer").
By booking a Session, the Client confirms that they have read and accept these Terms & Conditions.
2. Booking and cancelling sessions
Session times are arranged individually with the Trainer by phone, email, or another agreed channel.
The Client may cancel or reschedule a scheduled Session at no charge up to 24 hours before its planned start time.
A Session cancelled less than 24 hours before its planned start, or a no-show, is treated as completed — the Session is forfeited and counted against the purchased package, with no refund or rescheduling.
In justified, exceptional circumstances (e.g. sudden illness, an unforeseeable event) the Trainer may, at their sole discretion, waive the above rule — this does not create a right to the same treatment in future, similar situations.
3. Health status and Client declaration
Before starting and throughout the course of training, the Client must inform the Trainer fully and truthfully about their health, including past and current illnesses, injuries, surgeries, medication, pregnancy, and any other circumstances that may affect the safety of participating in a Session.
The Client declares that they have not withheld any health information relevant to selecting the intensity and type of exercises, and that they take part in Sessions at their own responsibility, consistent with the health status they have disclosed to the Trainer.
If in doubt about their health or the existence of contraindications to physical exertion, the Client must consult a physician before starting training.
The Trainer designs the training plan and selects exercises based solely on the information provided by the Client, and is not liable for consequences resulting from withheld, omitted, or false health information.
4. Liability
Participation in Sessions is voluntary and takes place at the Client's own risk arising from any aspect of their health not disclosed to the Trainer under Section 3.
The Trainer is liable under the general principles of Polish civil law for damage caused through their own fault.
The Trainer is not liable for damage resulting from: withheld or false health information, the Client's failure to follow instructions given during a Session, the Client independently performing exercises outside of Sessions or exceeding the recommended intensity, or events beyond the Trainer's control.
5. Payments
Package prices are listed in the "Program" section of the website, in Polish złoty (zł).
Payment for a package is due in advance, before the training cycle begins, in a form agreed individually with the Trainer.
A purchased package is valid for the period stated for that package; Sessions not used within that period for reasons attributable to the Client are forfeited, unless the Trainer decides otherwise.
6. Complaints
Any comments or complaints regarding Sessions may be sent to Jakub.pokora1@wp.pl.
Complaints are handled within 14 days of receipt.
7. Personal data
The rules for processing the Client's personal data are described in the Privacy & Cookie Policy, available on the website.
8. Final provisions
Matters not covered by these Terms & Conditions are governed by Polish law, in particular the Civil Code.
The Trainer reserves the right to amend these Terms & Conditions. Changes take effect upon publication on the website and do not affect Sessions already started and paid for before the change.
